These buildings included Midtown, Esha Ekta Apartments, Shubh Apartments, Patel Apartments, B Y Apartments and Orchid. The buildings had permissions to construct up to five floors, but went on to construct two additional floors. Shubh was granted an interim stay after the BMC issued demolition orders in 2005. Recently, after the SC order, the BMC moved the court for vacating the stay order. The society opposed it saying unlike other buildings in the compound, it had excess FSI and sought regularization of the illegal floors.

  • The Campa Cola Compund has been involved in a historic Supreme Court ruling in February 2013, with the highest court in India passing a judgement that all apartments above the 6th floor in these 7 inhabited buildings are illegal. The Buildings were constructed in 1987 and the necessary permits were not granted for them to be above a certain height. For the pats 25 years the government has not paid attention to this violation, however, negotiations for a new construction in the adjacent Campa Cola (worli) woke up the sleeping dogs and forced the supreme court to make a judgment. Residents are now trying to appeal the judgement as about 50 apartments will be affected by this.

  • Sad....very sad....really such things can happen only in India...i have just two questions with the authorities. 1.) Where was this BMC when these building plans were made, got approval and were built and got OC? does BMC not have any role in construction of (now so called) illegal buildings? so why only residents should suffer? BMC should be equally panelized. 2.) Campa cola came to the end of final verdict and shall be razed in near future. we have similar other case of illegal building...the Aadarsh society....what about that? why can't BMC, other governing authorities, High court and even SC is not able to take such solid steps for Aadarsh society....simple answer...because the low & constitution makers own flats in Aadarsh society.... Sad....
  • Snail supreme court of India is really a pathetic judgmental body of modern India. This body need to take quick action to improve themselves and remain watchful for their reputation and trust .
  • Pl. read the Apex Court judgment before commenting. It will answer all our apprehension and arguments.
  • What ever may be the judgements,the primary objective of the judge of law is to see that" no innocent is being punished" this is the main tenets of law. So please answer--- 1, How a illegal building gets water,electricity,and gas connection???? will the persons permitting this be punished ??? 2, By law if I walk through a lane for more than 12years, I built a right on that lane to walk for ever. 3, After demolishing the building, what will be done with this land??? 4 Will it be given to another builder or to public use ?????
  • @ prasun bose - If a person knows that the building does not have approval to build so many floors, then also he buys the flat because it is at discounted value to market rate - you call such a person 'innocent' , think twice.
