  To The Chairman/Manager, Respected Sir/Madam, I Shrimati Joanita Rodricks being a cancer patient would like to bring this subject to your kind notice. My Deceased Brother Shri Robert Sabino Britto residing at Kalamboli Navi Mumbai who was the member of the Shree Siddhivinayak Coperative Housing Society. (Regd. No NBOM/CIDCO/HSG/(04)/934/JTR/ 2000-2001 having address at Flat 1:8 First Floor A-2, Sector 10, Kalomboli, Navi Mumbai, Tal. Panvel, Dist Raigad, died on 17-08-2012. The said Shri Robert Sabino Britto had not made any nomination as provided under Rule 35 of the Maharashtra Co-operative Societies Rule 1961. The said Shri Robert Sabino Britto has left behind the following Heirs. Myself 1. JOANITA RODRICKS.(SISTER) 2. DOUGLAS BRITTO.(BROTHER.) There are no any legal dispute among the Heirs. According to Bye law No 35 of the bye law of the Society I have jointly made an Affidavit, Form of Indemnity Bond naming me to make an Application for Joint /Associate membership of the said deceased member in the said flat to our name. I had submitted No Objection Affidavit from my Brother Douglas Britto the other legal Heir having No Objection in Mutating the rights or interest in favor of me. All the documents: Application for membership by the Heirs( Applicant) of the deceased member along with entrance fee (Bye law No 35) Appendix No17. Affidavit from the legal Heir of deceased member stating that they have no objection if the society transfer the flat to the Applicant. Certified True Copy of the Death Certificate. List of Legal Heirs of the deceased member (Attested &Notarized by the court) Indeminity Bond from the Applicant stating that there are no Dispute among the legal Heirs and the Applicant agrees to indemnify the society for all expenses,losses,caused to the Society on account of transmitting the flat in the name of the Applicant.( Bye law no 34&35) Appendix 18&19. I had submitted the above documents to the Secretary &Office Bearers of the Society in person. The Secretary refused to accept the above documents and asked me to follow up with the concerned registrar. I would be very much obliged if you could Please help me to sort out this matter and let me know the steps to be taken to take possession or if you could send a letter to the secretary to solve the issue.
