During the 1950s, several landfills in the Alviso area accepted wastes from an asbestos cement pipe manufacturing facility. This waste was later used for raising the grade of the site and for constructing a ring-levee, resulting in asbestos contamination throughout the Alviso area and covering roughly 330 acres. The Site was listed on the Federal Superfund list in 1985. U.S. EPA has been the lead regulatory agency overseeing work.
On September 30, 1997, the EPA and Lincoln Property Company No. 2233 Limited Partnership entered into a Prospective Purchaser Agreement and Covenant Not to Sue for this portion of the superfund site. The agreement incorporated a Soil Management Plan describing soil control measures for asbestos and asbestos containing materials, methane, petroleum hydrocarbons, and lead. The Final Soil Management Report, dated 1999 describes the construction activities performed at the site pursuant to the requirements of the Soil Management Plan (1997). The construction activities included construction of a Cap (consisting of five two-story office buildings, pavement and 18 inches of clean soil in landscaped areas), and installation of a passive gas collection system to remove methane migrating upward from under the Cap.
