| There is a discussion at <!-- m --><a class="postlink" href="en.wikipedia.org/wiki/Template_talk:GeoTemplate#Wikimap...">en.wikipedia.org/wiki/Template_t ... #Wikimapia<!-- m --> where it is being contemplated that Wikimapia be removed from the Wikipedia GeoHack aggregation page for external map cross-references for places with articles in Wikipedia. This would be quite unfortunate. The decision rests on the perception that Wikimapia is violating the Google Maps/Earth Terms of Service. There is a request for clarification of the legal position via depositing a written supporting letter with [[Wikipedia:OTRS]]. Could someone (e.g. Koriakine) consider this? Thanks --CEY |

| Apparently, the issue is that tracing roads and polygons based on the Google satellite/map imagery might be considered a derivative work... and thus might be against Google's terms of service. |

[bumping, and adding my .02 cents]
Drawing roads and polygons based on the satellite images should be okay. That is the result of our own efforts. The exact shape of the roads cannot be owned by copyright IMHO.
However, drawing roads based on the Google Maps layer might not be okay. The shape of the roads in the Google Map layer are unique, and don't always reflect reality. Tracing the Google Maps roads might infringe on copyright. Perhaps we should discourage this practice whenever we see it?
I'm cautious to add that these are my own opinions. |

| I think you are right RAINGOD, but so far I only have copied maps in Ireland, Japan, Sweden and Hungary. there are not so many places where mapping is more detailed than what u see. |

As an example of my second assertion, please see: <!-- m --><a class="postlink" href="www.wikimapia.org/beta/#lat=40.73358&lon=-124.1433781&z=18&l=0&m=m&v=1">www.wikimapia.org/beta/#lat=40.7 ... =0&m=m&v=1<!-- m -->
Note the road named "Younger Lane", then switch to satellite view and look for this road. This road is a complete fiction and should not be drawn. If it is drawn, it would probably infringe on the Tele Atlas copyright. This stresses the importance of NOT TRACING THE GOOGLE MAP LAYER (emphasis only, not yelling). |
