Stay on Lanco, Emaar lifted
Hyderabad, Oct. 26: The AP High Court on Friday set aside the order of the single judge who stayed construction activity by Lanco Hills Technology Park Ltd and Emaar Properties in Manikonda village.
A division bench comprising Chief Justice G.S. Singhvi and Justice C.V. Nagarjuna Reddy passed the order while allowing writ appeals filed by Lanco and Emaar Properties challenging the orders of single judge.
Justice V. Eswaraiah on September 20 this year stayed the construction on a writ petition filed by H.A. Rahman, a Legislative Council member of the TRS, who contended that the land was part of 1,600 acres vested with the Wakf Board belonging to Dargah Hazarat Hussain Shah Wali in Manikonda village.
The bench observed that: "At this stage we cannot express conclusive opinion as several issues of facts and law are to be decided. It is impossible to believe that an MLC is not aware of the constructions being made by respondents. He has not approached the court with clean hands."
