Brief Note on Nandupalli Land
This land situated at Nandpalli, Maheshwaram Mandal is an ancestral land of Smt. Siraj Khatoon, Smt. Ruquia Khatoon and Smt. Nafees Khatoon.
They are the daughters of Late Hameed Khatoon w/o Late Ghouse Ali Khan, who is the actual pattadar his name is reflected in Revenue Records i.e Osool Bagie and Sethwar.
Ghouse Ali Khan reflects as pattadar in Khasra Phanies and Chesala Phani, and also mention in the Pattadar columns, after the death of Ghouse Ali Khan in the year 1959 Hameed Khatoon being the only wife of Ghouse Ali Khan her name was incorporated in the pattardar column of phanies.
At the time of death Ghouse Ali Khan left behind four legal heirs, being a wife of Ghouse Ali Khan, Hameed Khatoon’s name was mutated and her three daughters were married.
Hence most of the time Hameed Khatoon stay with her elder daughter Smt. Siraj Khatoon in Raichur Karnataka state so she cannot take care of her properties, being a women she never came out of house and nobody is there to take care of her properties.
When the villagers know about her weakness they took advantage of this land and started encroaching the land and made lot of bogus sada benames, putting money and influence in the Mandal, village Sarpanch and Secretaries, taking this advantage and started incorporating the villagers name in the phanies as in the pattadar column and also slowly villagers started land grabbing our whole land i.e. Approximately Acers 364.35 by illegal means.
Land admeasuring an extent of Acers: 364.35 in Sy. Nos. 64, 86, 87, 88, 89, 90, 93, 94, 100, 105, 107, 108, 109, 111, 112, 118, 119, 120, 121, 122, 123, 124, 125, 126, 127, 128, 129, 130, 131, 132, 133, 134, 135, 136, 137, 138, 139, 140, 141, 142, 143, 144, 145, 146, 147, 148, 149, 150, 151 and 152. Situated at Nandupalli Village, Nagaram Village of Maheshwaram Mandal Ranga Reddy District.
Hence we have the brief of phanies extracts that shows how they changed their names from tenant column to pattadar column.
We have the evidence that lot of fake registrations occurs after the death of Hameed Khatoon in the year 1987 & 1988.
As Follows:
1. Sy no. 112
Hameeda khatoon has expired on 10.02.1981 and in the year 1988 some miscreants tried to grab land by ways of bogus registration sold the land in sy no. 112 admeasuring acres 10.05 guntas vide sale deed no. 3777 dated 22.01.1988 by impersonating as hameed khatoon in favour of vattela mallesha s/o komaraiah & 2 others and got their names updated in the phanies ( i.e registration executed after the death of Smt. Hameed khatoon i.e SEVEN YEARS).
1. M. Nazeer khan husband of Smt. Siraj khatoon approach the authorities in the year 1989 -90.
On 27.03.1991 vide file no. B/265/91, signed by MRO informed to collector that entries made in col. No. 12 & 13 correction made as per instruction by collector B1/2206/91
2. In the year 18.04.1991 submitted letter to collector to implement the entries in u/s 5A of ROR 1971 act and complaint against illegal entries made by village assistant Sri.Azizuddin and request & instruct to MRO not to implement entries in ROR on the basis of bogus documents.
3. Mandal Revenue officer, Maheswaram has given us the Legal Heir Certificate vide office file no. 660/91 dated 27.08.1991 in the names of Mrs. Siraj Khatoon, Mrs. Ruqia Khatoon and Mrs. Nafeez Khatoon daughters of Late Hameed Khatoon for the above said land.
4. On the basis of legal heir certificate 660/91, registering officer issued certificate of encumbrance on property. Clearly mentioning that Sy. No.s 105,108,112,120,148, & 152. Acres 59.14 guntas land situated at Nandipally village as Maheswaram R.R Dist bounded by full Sy. No.s party declared owner Smt. Hameed Khatoon.
Search has been made from 01.01.1960 to 19.06.1991 and issued on 25.06.1991 by registering officer.
5. Inspite of correction the above persons namely Vettela Mallesha s/o Komaraiah & 2 others has sold the property to Mamne Yadi Reddy s/o Roshi Reddy & 4 others vide sale deed no. doc. No. 1956/1990 and they got their names was updated in phonies leaving 0.05 guntas in the name of late Hameed Khatoon.
6. Complained lodge in the Ibrahimpatnam police station R.R Dist. On 31.07.1991 by registered post, mentioning that above persons deliberately with malafied intentions committed an offence of impersonation, forgery and cheating.
7. In the year 1992 Maheswaran Mandal did the correction in the phanies and issued as per certificate 660/91 and mentions the names of daughters of Hameed Khatoon in the Sy No.s 108, 112/1 & 120.
8. To misguide and confuse to Maheshwaram Mandal, RDO and owners of the land, above persons and Anant reddy by illegally get the GPA copy of M. Nazeer khan h/o Siraj Khatoon by unknown person executed agreement vide Doc No. 68/95 & 69/95 Dated 20.06.1995, stating that Smt. Siraj Khatoon, Ruqia Khatoon and M. Nazeer khan sold the land acres 10.05 guntas to Gajjela Hamsavani w/o Bhasker and Gajjala Bhasker s/o G. Mallesh.
9. The same persons by name Mamne Yadi Reddy s/o Roshi Reddy & 4 others who did the sale deed no. doc. No. 1956/1990 again they sold the land 10.05 acers of land vide sale deed doc no. 784 dated 02.08.1996 and 785 dated 02.08.1996 to K.R Praveen & K.R Pramod, 5.00 each.
10. That on 16.07.1998 and 01.09.1998 vide file no. A/2430/1998 appeal to the revenue division officer, east division, Ranga Reddy district, Maheshwaram Mandal – Nandipally village under section 5 (5) of ROR act 1971 for rectification of wrong entries in the ownership column of pahani for the year 1995-96.
11. As we mention the persons above K.R Praveen & K.R Pramod, holding ac.5.00 each sold to P. Vishnu Vardhan s/o P. Sayyam vide sale deed no. 697 & 698 dated 12.03.1998 Ac. 10.00
12. That on 25.06.2002 further submitted an appeal to RDO to rectify the 1995-96 records. And on 21.01.2006 vide file no. A2/2430/98 the Hon’ble court special grade Deputy Collector and Revenue Divisional officer, Ranga Reddy Ext-Division presented by Hon’ble K. Ramulu pleased to allow the appeal and passed the order in our favour and order was passed as fallows.
13. On 21.01.2006 the appeal is allowed. The M.R.O. Maheshwaram Mandal is directed to rectify the entries made in the revenue records from 1995 -1996 by deleting the names of respondent no’s 1 to 5 namely Manne Yadi Reddy and 4 others as pattedars of land bearing Sy. No. 112/1 admeasuring Ac. 10.05 gts of Nandipally village, Maheswaram mandal.
14. Even after the orders were issued by Hon’ble court no action was taken by the Maheshwaram Mandal to rectify the names in the pahanies and after continuous follow-up the office of the Maheshwaram Mandal Revenue office has issued a MEMO vide latter no. B/515/2006 dated 19.04.2006 to rectification of records Nandipally village addressed to the Panchayat secretary Nandipally village, and in 2005 – 2006 the panchayat secretary, Nagaram village, Masheshwaram Mandal has issued pass book in our names & kacha pahani certificate clearly stating that the only owners of the above land by MRO order no. B/515/2006 dated 19.04.2006.
15. Notice issued for correction of records –ROR. Of Nandipally village Sy. No. 108, 112/A and 120 for the correction and implementation of Revenue records in the year dated 01.11.2006 vide file no. Lr.no.D/2906/2006. They did not issue on the land owners address, deliberately Green City Venture and Vishnu Vardhan hide this notice by bribing officers in Mandal and RDO. When the owner meets with these persons they gave this copy in the year 2009.
16. After everything cleared that Ac. 10.05 gts belongs to Smt. Hameed khatoon and her daughters Smt. Siraj khatoon, Smt. Ruqia Khatoon and Smt Nafeez khatoon. Again Vishnu Verdhan appeal RDO courts vide case no. D5/3178/07 dated 15.12.2007.
( see no. 4: it is further claimed that originally one Smt. Hameed Khatoon was the pattadar and possessor of the land in sy. No. 112, extent ac. 20.15 gts situtated at Nandipally of Maheshwaram Mandal. She sold an extent of Ac. 10.05 gts, to Vitte Mallesham and other through un-registered deed. The same is validated by MRO vide proceeding no. D/2880/89.)

Vishnu Vardhan supporting land grabber to protect his grab land and other Ac.10.10 gts by illegally means on his son and daughter. Now Vishnu Vardhan illegally enjoying ac.20.10 gts, suppose to owner of land Smt. Hameed khatoon’s daughters should enjoy.
17. Now impersonate unauthorized purchaser of Sy. No. 112 admeasuring Ac.20.15 gts of Smt.Hameed khatoon now harassing and not allowing to dispose land and given public notice in Eenadu newspaper dated 09.03.2008 stating that actual owners have no rights to ownership over the said land and they are the owners.
18. Replied through legal notice to Harshavardhan, P. Vishnu Vardhan and Kumara Niharika through advocate H. Sudhakar Rao,
2. Sy No. 120 & 108
1. By registered post legal notice issued to Shri. Krishna Yadav on 04.07.1991, for illegally using land for the manufacture of brick.
2. Public notice issued on 23.08.1993 Eenadu news paper, China Narayana cancelled GPA dated 20.01.1992 executed in favour of G. Anantha Reddy.
3. Public notice received through Eenadu and Siasat dated 24.09.2002 that Ashok Kumar Agarwal and 4 others stating that their client agree to purchase dry land of Sy. No. 120, through Smt. B. Srivinas Reddy, B. Sudhakar Reddy and Narendra Reddy.
4. Reply notice issued on 02.10.2002, stating LRs of the deceased original pattedar viz Smt. Hameed Khatoon and her daughters.
5. RDO issued letter vide C.C no.433/2002 dated on 18.10.2002 stating that there is no protected tenant over the land bearing Sy. No. 120.
6. Public notice issued in Eenadu English and in Telugu on 14th and 15th august 1995. Stating that land bearing Sy. No. 112, 108 and 120 belongs to pettadar Smt. Hameed khatoon.
7. Certificate of encumbrance on property year 16.12.2008 for the survey No.s 105,108 & 120
3. Sy no. 148 & 152

3. On 13.06.2008 vide no. D/3090/2007, stated for the correction of entries of survey no’s 148 & 152 Acers 17.34 gts, order is in the favour of Smt.Hameed khatoon,
4. On 01.11.2008 vide appeal no. A2/2915 – 2008 stating that Ameer khan purchase land through un-registered agreement and after the death of Ameer khan his three sons are illegally occupied.
5. In the year 16-2-2009: Order has passed in our favor in the court of the special grade deputy collector & revenue. Divisional officer, R R east division. Present: Sri T Manikyala Rao.
Stating the order of the Tahsilder, Maheshwaram passed in file no. D/3090/07 dt. 13.6.2008 is hereby set aside along with the defective order passed in file no. D/1643/89 dt. 3.7.1991 and the matter is remanded to the Tahsilder, Maheshwaram with a direction to conduct denovo enquiry while giving reasonable opportunity to the parties concerned and pass appropriate order restoring original entries in the pahani duly following the laid down procedure as contemplated under ROR act & rules. The appeal is allowed accordingly.
6. Also we applied for mutation due to lack of funds we are not able to proceed for mutation. We were looking financially and politically strong person to purchase this land.
7. As per new master plan these sy. No 148 & 152 is covered with three main roads.
Conclusion:
The present legal heirs are the actual owners and the persons in possession are illegally occupied the land and have no rights on the said land and if any transaction in respect of the above survey Nos. are done after the death of Ghouse Ali Khan and Hameed Khatoon reflecting as if they have registered/executed the said transaction is not possible which is illegal and not correct.
As far as there is no link document with the persons in possession stating that Ghouse ali khan or Hameed khatoon executed or registered any deeds.
All the legal heirs are out of state and out of country and if any registrations occur in this period from 1959 to 2009 are bogus and fabricated.

3. On 13.06.2008 vide no. D/3090/2007, stated for the correction of entries of survey no’s 148 & 152 Acers 17.34 gts, order is in the favour of Smt.Hameed khatoon,
4. On 01.11.2008 vide appeal no. A2/2915 – 2008 stating that Ameer khan purchase land through un-registered agreement and after the death of Ameer khan his three sons are illegally occupied.
5. In the year 16-2-2009: Order has passed in our favor in the court of the special grade deputy collector & revenue. Divisional officer, R R east division. Present: Sri T Manikyala Rao.
Stating the order of the Tahsilder, Maheshwaram passed in file no. D/3090/07 dt. 13.6.2008 is hereby set aside along with the defective order passed in file no. D/1643/89 dt. 3.7.1991 and the matter is remanded to the Tahsilder, Maheshwaram with a direction to conduct denovo enquiry while giving reasonable opportunity to the parties concerned and pass appropriate order restoring original entries in the pahani duly following the laid down procedure as contemplated under ROR act & rules. The appeal is allowed accordingly.
6. Also we applied for mutation due to lack of funds we are not able to proceed for mutation. We were looking financially and politically strong person to purchase this land.
7. As per new master plan these sy. No 148 & 152 is covered with three main roads.
Conclusion:
The present legal heirs are the actual owners and the persons in possession are illegally occupied the land and have no rights on the said land and if any transaction in respect of the above survey Nos. are done after the death of Ghouse Ali Khan and Hameed Khatoon reflecting as if they have registered/executed the said transaction is not possible which is illegal and not correct.
As far as there is no link document with the persons in possession stating that Ghouse ali khan or Hameed khatoon executed or registered any deeds.
All the legal heirs are out of state and out of country and if any registrations occur in this period from 1959 to 2009 are bogus and fabricated.
