NEW YORK (AP) -- Vietnam's ambassador to the United Nations is claiming diplomatic immunity after being accused of illegally digging for clams on Long Island. Ambassador Le Van Bang and his driver, Toan Nguyen Dinh, were spotted July 31 in East Hampton's Hog Creek, carrying plastic bags filled with clams, town officials said. The two men "acted like they didn't speak English when they were confronted by the harbormaster," said the town prosecutor, Scott Allen. After police were called, Le and Toan dropped the bags of clams and claimed diplomatic immunity, the Daily News reported Friday. The men were ticketed for illegal shellfishing and littering. Clamming without a license carries a $250 fine. The men are due in town court Oct. 3. Allen is researching whether diplomatic immunity applies. "Apparently, there are two different levels of diplomatic immunity," Senior Harbormaster Bill Taylor said. "The ambassador is total diplomatic immunity, the driver may be at a different level." Nguyen Thi Hong, a spokesman at Vietnam's U.N. mission, said the incident was a misunderstanding. "They were not picking up clams. They were just swimming around," he said. ............ Consul-General Nguyen Viet Hung was taken to a police station and questioned over the alleged offence but released after he claimed diplomatic immunity, the South China Morning Post reported. In an interview with the newspaper published Tuesday, Nguyen categorically denied committing an offence, saying: "I'm a top level diplomat...Can you imagine that I would assault a woman in the street." Married Nguyen was arrested after a woman claimed he groped her bottom in the street in the busy Causeway Bay shopping district on January 18. She rang police on her mobile phone immediately after the alleged offence and Nguyen was taken to Hong Kong's Wan Chai police station, where he was released after claiming immunity, the Post reported. Hong Kong police are preparing a report on the woman's complaint against Nguyen which will be forwarded to the Department of Justice to decide whether to take any further action. Nguyen, who only arrived in Hong Kong to take up the consul- general position in October, said he had been walking home from his office to his Causeway Bay home at the time of the incident. "I was walking very quickly," he said. "Suddenly a woman stopped me and shouted something in Chinese near the Sogo department store...I was so surprised." He said of the allegation: "I never fulfilled this action...I never, because I've worked in our ministry for 20 years. I'm a top-level diplomat." Under the Vienna Convention, diplomats are entitled to immunity from arrest or detention pending trial except in the case of a "grave crime". A "grave crime" is defined in the Hong Kong Consular Relations Ordinance as one that would be liable to five years or more in jail. Police consulted the Hong Kong government's Protocol Division to check on Nguyen's status after his arrest, the Post reported quoting police sources. They were advised to release him unconditionally. If Hong Kong's Department of Justice decides to take the case any further, it would need to ask Vietnam to relinquish its right to diplomatic immunity to allow a prosecution to proceed, a legal expert told the Post. 3) Bí Thư buôn lậu (sừng tê) Vietnamese diplomat caught smuggling rhino horn A Vietnamese diplomat was caught by a news crew smuggling rhino horns in South Africa. From Bloomberg News: Vietnam recalled a diplomat from its embassy in South Africa after a television program allegedly showed her trafficking rhino horn, according to the Ministry of Foreign Affairs. The employee was filmed by the South African Broadcasting Corporation talking to an alleged trafficker in front of the Vietnamese embassy in Pretoria, according to a report in Thanh Nien newspaper today. The person was filmed taking rhino horn from the diplomat and putting it in the trunk of his car, Thanh Nien said. “The Ministry of Foreign Affairs’ stance is to be strict in dealing with all acts of illegal trafficking and sales of wildlife and other negative actions in accordance with Vietnamese law and international regulations,” the ministry said in a statement yesterday. Tòa Đại Sứ cho rằng đó là súng giả và khi bị triệu đến Bộ Ngoại Giao Anh để trả lời về việc nầy, đại sứ Việt phải nạp súng thật và đưa tên tham tán nầy ra khỏi nước Anh vì hành vi côn đồ nầy. Xém tí nửa là chính quyền Anh đóng cửa tòa đại sứ VC vì vụ nầy. 5) Lảnh Sự Quán bán thông hành Việt Nam Báo chí Nhật đã cử phóng viên điều tra việc các cơ quan ngoại giao của Việt Nam tại Nhật bán giấy tờ giả. Một phóng viên Nhật đã thử liên lạc và cuối cùng mua được một passport từ Lãnh sự quán CSVN tại Osaka với giá chỉ có 30,000 yen, dù anh ta hoàn toàn không phải là công dân Việt Nam và không biết nói tiếng Việt.
